Before and During the Trial – Thinking Critically with AI as a Thought Partner
Question 1: Preliminary Hearing
The law allows to skip the preliminary hearing because this step is mainly used to determine if there is enough evidence for a trial. A defendant may choose not to attend this hearing if he thinks that the trial will go to a trial anyway, to gain time and to dodge more legal costs. From Module 5, I have learned that preliminary hearing is optional and only focuses on the probable cause rather than guilt. After discussing with the AI I also learned that skipping this hearing can prevent the prosecution from learning details about the defense’s strategy too early. In my opinion, this option protects the defendant’s rights by allowing them to choose the strategy that best fits their case.
Question 2: Change of Venue Case – Boston Marathon Bombing
In the Boston Marathon bombing case involving Dzhokhar Tsarnaev, the defense requested the change of venue because of the extensive media coverage and the strong impact on the community. I think a change of venue was needed for the smooth running of the trial. Indeed, in Boston many people were personally affected by the attack and could already believe that the defendant was guilty. The article explained that advertising can influence the jurors even before the trial begins, which can make it difficult to find an unbiased jury. From Module 5, I learned that a motion for change of venue is used when a fair trial can’t be possible in the original location. Based on this information and my discussion with AI, I think moving the trial could help ensure the jury focuses only on the evidence presented in court. Based on this information and my discussion with the AI, I believe that moving the trial can help to make sure that the jury is really fair and only focuses on the evidence presented in court.
Question 3: Most Important Step in the Trial Process
I believe that the jury selection is the most important part of the trial to make sure that it is fair for the defendant. This step determines if the jury can be unbiased and willing to listen to both sides fairly. From Module 5, I learned that both the prosecutor and defense lawyer work together to remove jurors who may be prejudiced. Finally, after talking with the AI, I realized that even with strong evidence a person can be unjustly judged if the jury was biased from the start. In my opinion, a fair jury is the foundation for all the other steps in the trial process.
