Chapitre 1 :  law studies

World legal systems are classed several categories:

🡪 depending on the type of law on which they are bases

  • Civil law: law is codified, the role of the judge is to identify and apply the statutory rule to a particular case
  • Common law: judge resolve disputes by examining how similar cases were decided in the past and apply the same reasoning.
  • Religious law (Muslim, Jewish); seeks to apply moral values and ethical standard believed to be laid down by God as interpreted by jurist or sacred texts.
  • Customary law: is focus established social norms or rules prescribed by a chief or community authority.
  • Socialist law : 1 type of legal system, rooted in civil law, is also a category of law in itself

In practice, many legal systems are hybrid

🡪 In Morrocco Islamic law + French and Spanish civil law

🡪Development and functioning of common law systems in India, Nigeria, South Africa

Si tu veux faire des recherches ou travailler dans des orga international il faut avoir un Ph. D. il y a aussi l’équivalent en J. D jurist doctorate. Au RU ils ont aussi une sorte de parcoursup mais c’est sous forme d’association

Germany: 0 but administrative fees between 170 and 800

In Sweden 🡪 free for EU students

Denmark: free for EU students bur non-EU students pay 6,000 and 16,000.

Il y a un débat sur le prix des études pour les étudiants 🡪 les faire payer et ensuite se “rembourser” avc l’argent qu’il se ferons plus tard ou alors faire payer la société.
