ESSAY: What are the limits to the right of expression ?

First, the right to express one’s ideas and opinions freely through speech, writing, and other forms of communication without deliberately causing harm to others’ character and reputation by false or misleading statements. Freedom of press is part of freedom of expression. To illustrate this definition, we can take an example: in a high school, student has the right to express what they think, but if one student express their way to think by banging and disturbing another student, is it normal? The other student can respond by hurt the striker with lots of ways, but he don’t, because he knows that he is not allow to do that, it’s forbidden by the law.

Well, the right to freedom expression is crucial in a democracy. Information and idea help to enrich political debates. Article 10 of the constuation gives everyone the right to freedom of expression. This includes the right to communicate and to express oneself in any medium, including through words, pictures, images and actions. The right to free expression would be meaningless if it only protect certain types of expression, so the right will protect both poplar and unpopular expression, including speech that might shock others. Interferences on free encyclopedia usually involve restrictions on publication; penalties for publication; requiring journalists to reveal their sources; imposing disciplinary measures of confiscating material.

Last, article 10 is a qualified right and as such the right of freedom of expression may be limit. Article 10 provides that the exercise of this freedom “since it carries with duties and responsibilities” may be limits as long as the limitation because: is prescribed by law and it is necessary and proportionate and pursues a legitimate aim. In considering question of proportionality the potential for a chilling effect on expression, the value of the particular form of expression, the medium used for the expression will all be taken account, along with other considerations. In case, article 10 also provides that it does not prevent the government from requiring the licensing of broadcasting television or cinema enterprises, although such restrictions must still be in accordance with law and b necessary and proportionate.

For ended, we can say that “your limits for the right to expression finish where mine start”. We can link this with two notions; first with the idea of progress because expression and opinion of people take forward the world, we can take the example of the president, because he is accept by people by his ideas. And, secondly it can be link with spaces and exchanges because freedom of expression allows trades or communications.
