As we have seen throughout the presentation, death penalty has been a major political, social and judicial issue for several centuries in the whole world and more particularly, in that case, in the Unites States. It is still supported by the majority of the American population showing the controversy of the issue. Indeed, according to a 2011 Gallup poll, 61% of Americans favored it in cases of murder while 35% opposed it. However, being more and more influenced by other countries, international organizations and NGOs, mentalities are evolving. Thus we can think about an evolution going towards the abolition of death penalty over the next few years.

Indeed, throughout the history of the United States, there has been several signs showing the American reluctance to abolish. Capital punishment was suspended in the United States from 1972 through 1976 primarily as a result of the Supreme Court's decision in Furman v. Georgia. People thought this meant a complete abolition of death punishment. However, in 1977, following the states of Florida, Georgia and Texas, 38 other states decided to reintroduce death penalty their judicial system.

The Supreme Court also accepted in September 2007 to hear the appeal of two men, Ralph Baze and Thomas Bowling, who were sentenced to death in Kentucky. The Court suspended all executions with a moratorium that lasted for about 6 months. However, the Court rejected the challenge thereby upholding Kentucky's method of lethal injection. Followed several executions and no change of the legislation.
