Chapitre 1- A general approach of England   Common Law

Several legal systems cohabit in Britain:

             

                  _ English law

                  _ Scots Law

                  _ Northen Irish Law

                  _ Bristish Law, common to the whole nation

                  _ European Law, until 19/03/19 because of the Brexit

 

They aslo have types of law:

           

                  _ the civil law who permit to harmonised and is an arbitrary between              

                           people

                  _criminal law who is repressive and is here to imposed a punishment

Law is never in a vaccum

He have a have a special context like socio-economic, political, historical, geographical, cultural, environmental…

A- England and Wales; a specific geography

The UK is a special geography, is an island country (pays insulaire)

He has 300 ports and coastline who represent 12000 km

The England Channel (La Manche) is a protection; she is not easy to invade

The UK faces to the influence on the development of:

 

          _ national identity

          _ the state

          _ the legal system

The migrants situation is aslo special; the treaty of Le Tourgat (2003) treats about it

The UK has migrants checks points at the ports of Calais and Dunkrik

The migrants check take place before boarding the ferry but not in Britain

The Britain has a very old link with the European Union, this link Influence the Roman Law

Britain still belongs to the European Union, he joined it in 1973

He must respect the European Law made by

 

         _ European Parliament (Strastbourg)

         _ European Commission ( Brussels)

         _ European Court of Justice (Luxembourg)
