j'ai choisi ce sujet parce que en classe nous avons beaucoup travaillé sur l'art et le débat et nous avons étudier les œuvres de Banksy, un street-artist très influent et qui est surtout un génie dans l’art des graffitis. Lors de cette étude nous avons pu voir que le graffiti est un excellent moyen de s’exprimer et de faire passer un message, c’est la raison pour laquelle les artistes qui utilisent cette méthode comme Banksy par exemple l’utilisent généralement pour parler d’un sujet sensible, critiquer, dénoncer ou encore exprimer leurs mécontentement face à une société de consommation complètement inégalitaire.

Pendant cette prise de parole je vais m’intéresser au graffitis, je vais tout d’abord vous parler de la sphère artistique et polémique du graffiti,puis ensuite, nous allons nous intéresser à sa sphère juridique afin de mieux comprendre pourquoi le graffiti est considérer comme une infraction ou encore un acte de vandalisme.

Firstly, Graffiti is a type of marking on property, both private and public. It can take the form of pictures, drawing or words on any surface usually outside walls and sidewalks. Most of the time, the aim of the graffiti is to send a message or denounce something and it’s an important kind of art because it is thought-provoking and accessible to all. people don't need to buy a ticket to see a graffiti and it's important to remind it because it shows that graffiti is a pure tool of freedom of expression and not a way to make money.

Now we are going to see that graffiti is not always considered as illegal but can very quickly become one if certain rules are not respected. Indeed, Freedom of expression is a constitutional right that can be exercised through the creation of art, but this right has limits. According to the Criminal Code, when graffiti is painted in an unauthorized location and damages walls, facilities, dwellings or street furniture, it is considered mischief or vandalism.

A person found guilty of painting graffiti that damages property or a building worth less than $5,000 could receive a jail term of up to 2 years. If the value of the property or building damaged is more than $5,000, the jail term can be up to 10 years.In addition, if hateful or racially motivated graffiti is painted, one could also face other charges for example public incitement to hatred which could result in further penalties.

however street artists can continue to paint their graffiti on so-called "legal" walls. Absolutely! Many municipalities have designated areas ("legal walls") on which artists can paint graffiti, in which case the graffiti becomes completely legal. There is a website called legal-walls.net that allows artists to locate legal walls around the world. In total, there are more than 1,700 of them!

Artists can also simply ask permission before painting their graffiti, so this act will not be considered as vandalism and influential artists will have no trouble getting permission.

But asking permission before painting a graffiti could make it lose all its meaning because graffiti is often a way to criticize society, therefore to paint a graffiti illegally is to be able to express yourself freely. Shepard Fairey is an American artist always on the edge of illegality. His work is known worldwide since the poster supporting Barack Obama's campaign in 2008.

To conclude, Graffiti is considered an act of vandalism because it represents the deterioration of public property but it becomes legal if it is done on a legal wall or if the artist asks for permission from the municipality before doing so. However, graffiti is a way to denounce and show discontent, so painting a graffiti illegally makes it more meaningful and carries the message better.
